Bob, the State of Florida and the Abandoned Shipwreck Act unfortunately now seem to take a back seat to the Florida Keys National Marine Sanctuary (NOAA). The FKNMS issue permits for Salvors to work anywhere in the Keys. But your question is a valid one and one that has been in search of an answer since the early part of this decade when Spain jumped in and tried to stop a salvor near the Tortugas from recovering a shipwreck claimed to be carrying Spanish goods.
Since that time all questions regarding Spain’s ‘RIGHTS’ to the Key’s shipwrecks has been avoided by the FKNMS officials. But they DO admit that anyone requesting a permit on a ship, which is claimed to be Spanish, than that request must first be sent to Spain for THEIR approval. It sort of diminishes NOAA’s assertion that the FKNMS was established to protect (for us) the Keys cultural resources. If their idea of protecting OUR resources is to give them away, my guess is that the citizens of this country would have a serious problem with that.
The only way that we as salvors (and citizens) will be able to get any answers is to continue to request a definitive answer from our government officials. The FKNMS Advisory Council was set up specifically to address these issues by representation. The Salvors representative on this board is Gary Randolph, and requests to bring this to the attention of NOAA should be forwarded to him to be brought up and clarified by the council before Spain jumps all over another one of the Salvors of the Keys for taking THEIR property. |
