Please pay special attention to the purpose of this Act: established for use on Federal (public) Lands and Indian Lands only, focused on Excavating and Interstate Sale of artifacts.
Notice under Section 6 Item 6 of the "Prohibited Acts & Criminal Penalties" that arrowheads found on the surface are allowed to be collected; and again in Section 7 Item 3 under "Civil Penalties" it is allowed! This was good common sense when writing this Act, since they knew it would be impossible to stop every boy scout and even a grown person from wanting to pick up a stray arrowhead if they saw one laying on top of the ground.
Pay attention also to Section 3, Item 1 of this Act under "Definitions" where it states any item to be considered an significant artifact has to be at least 100 years of age.
And for us metal detector users, Section 12 Item (b) under "Savings Provisions" it states "any rock, coin, bullet and mineral" is exempt from being considered an artifact of significance by this Act.
Now last is Section 12 Item (c) where it states any lands other than public or indian lands is permitted to recover and collect artifacts from.
Now this is federal law, but we both know that state law and government regulations make their own changes such as the 100 year rule stated in the Act against the other states and agencies rules of 50 years. So the question is, which law should the America people obey? Federal Law made by the lawmakers we trust as caretakers to oversee our interest and needs OR state laws and government regulations that at will, change and mis-interpret federal laws to suit themselves and to achieve their goals. Until this is addressed in our higher government, we will continue to have such arrest of legal activities such as with the events that is now happening in Florida and many other states as well. There should be no reason why Federal Law would not out weight state and agencies laws and regulations. This Act should be studied and learned by everyone that metal detects in this country today.
